My conditions for advice, travel planning and booking
1. Provider and scope
I am Manuel Jairo Flühmann and operate Jairo Travel in Switzerland. These conditions apply to my services. Your quotation and booking conditions communicated before the contract specify each assignment.
Mandatory statutory rights take precedence.
2. Enquiries and initial consultation
An enquiry through the contact form, route planner or video consultation is non-binding. It triggers no booking or payment. I offer a free initial consultation of around 30 minutes.
Paid advice or planning starts only after express agreement on scope and fee.
3. Quotation and contract
Before a binding booking, you receive my quotation. It lists services, travel dates, prices, payment deadlines and contracting parties. Applicable amendment and cancellation conditions are also included.
The quotation states the contract procedure and its validity period. An automatic enquiry acknowledgement confirms no booking.
4. Advice, intermediation and travel organisation
I advise you and plan routes around your wishes. On request, I arrange flights, accommodation, transport and activities. When acting in another provider’s name, I identify that contracting party before booking.
For services in my own name, the actual contract and applicable law determine my duties. A tailored itinerary does not exclude the Swiss Package Travel Act.
5. Prices and payment
I generally quote prices in CHF. Your quotation states the total price, included services and agreed planning or intermediation fees. Any excluded costs are also listed.
I take legally payable taxes and charges into account. Booking documents state available payment methods and deadlines. They clarify card, TWINT or bank transfer.
Unagreed additional services trigger no automatic chargeable booking.
6. Changes and cancellations
Send change or cancellation requests to me promptly in writing at info@jairotravel.ch. Conditions communicated and validly agreed before the contract, and applicable law, govern your request. I charge completed work and third-party costs only within agreed, legally permitted limits.
Statutory withdrawal, refund and compensation rights remain unaffected.
7. Travel documents and preparation
You provide me with correct information for planning. This includes names matching travel documents, dates and relevant requirements. You are responsible for obtaining valid documents and necessary visas in time.
My statutory information duties concerning entry and public-health formalities remain unaffected. Medical questions about your circumstances require medical advice.
8. Support and complaints
I record agreed support and contact channels in your travel documents. Report difficulties promptly to the relevant provider and me. This allows a remedy to be considered.
A staffed 24-hour emergency service is included only if expressly agreed. Statutory assistance duties remain unaffected.
9. Responsibility and liability
I remain responsible for my contractual services under applicable law. Where the Package Travel Act applies, statutory performance and liability duties remain. That also applies when other service providers participate.
No blanket liability exclusions are imposed for third-party services, bodily injury, intent or gross negligence.
10. Insurance and customer funds
Personal travel, cancellation or assistance insurance is included only if I expressly list it. For package travel, the contracting organiser or intermediary must provide legally required financial protection. This covers insolvency or bankruptcy; evidence must be provided on request.
Without that evidence, Article 18 of the Package Travel Act provides withdrawal rights. You must communicate withdrawal in writing before departure.
Customer-fund protection for Jairo Travel is still being arranged. I currently confirm neither active cover nor guarantee-fund membership.
11. Privacy
My website’s privacy policy governs the processing of your information. I explain necessary recipients and extra information for a booking during travel organisation.
12. Law and contract language
Swiss law applies. Mandatory protections and statutory places of jurisdiction remain unaffected. I agree your quotation and contract language with you at booking.
Website translations do not change mandatory statutory rights.
